This Acceptable Use Policy (“AUP”) applies to all users of the Perks Hive platform, including merchants, consumers, and visitors. By using the Perks Hive platform, you agree to comply with this AUP. Violations may result in account suspension or termination.

1. For Merchants

1.1 Prohibited Loyalty Program Structures

The following program structures are prohibited on the Perks Hive platform and may constitute violations of Australian law:

Prize draws, lotteries, or games of chance — any promotion where the outcome is determined by chance rather than the customer's own actions (violates the ACL and relevant state gaming laws)
Cash-back or cash-equivalent rewards — loyalty points and rewards must have no monetary value and must not be exchangeable for cash (could trigger ASIC financial product regulation)
Multi-level or pyramid referral schemes where rewards are based on recruiting other merchants
False or misleading promotions — claims about reward values or availability must be accurate

1.2 Prohibited Data Practices

Sharing customer data collected through Perks Hive with any aggregator platform (e.g. delivery apps, booking platforms) without explicit customer consent
Using the push notification feature to send messages unrelated to the customer's loyalty program
Sending unsolicited commercial messages to customers who have opted out
Using customer data for purposes beyond loyalty program delivery and business analytics

1.3 Prohibited Platform Use

Attempting to reverse-engineer, decompile, or extract source code from the Perks Hive platform
Introducing malicious code, viruses, or any software intended to damage the platform
Creating multiple merchant accounts for the same business to circumvent plan limits
Reselling access to the Perks Hive platform without written authorisation

2. For Consumers

Do not create multiple consumer accounts to accumulate loyalty balances fraudulently
Do not attempt to manipulate or exploit bugs in the stamp or point system
Do not share your loyalty card QR code with others to accumulate stamps fraudulently
Do not use the platform for any illegal purpose

3. For All Users

Do not use the platform to harass, abuse, or threaten any other user or staff member
Do not use the platform to distribute spam, phishing attempts, or malicious links
Do not impersonate any person or entity
Do not violate any applicable local, state, national, or international law

4. Enforcement

Perks Hive reserves the right to:

Investigate any suspected violation of this AUP
Suspend or terminate accounts where violations are confirmed
Remove or disable content that violates this AUP
Report illegal activity to the appropriate authorities

For serious violations — particularly those involving fraud, illegal lottery mechanics, or data misuse — suspension will be immediate and without prior notice.

5. Reporting Violations

If you become aware of a violation of this AUP by another user, please report it to:

6. Changes to This Policy

We may update this AUP from time to time. Material changes will be notified with at least 14 days notice.
