These Consumer Terms of Service (“Terms”) govern your use of the Perks Hive platform as an end consumer. By creating an account, adding a Perks Hive loyalty card to your wallet, or using the Perks Hive dashboard, you agree to these Terms.
If you are a merchant or business signing up for the Perks Hive merchant dashboard, please refer to the Merchant Terms of Service.
1. Agreement to Terms
These Terms constitute a legally binding agreement between you (the “Consumer”) and Perks Hive. By using our service, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.
2. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms is intended to exclude, restrict, or modify any non-excludable right or remedy you have under the ACL or other applicable laws.
3. Your Loyalty Account
- You must provide accurate information when creating a Perks Hive account
- You are responsible for maintaining the security of your digital wallet and Perks Hive account
- You must notify us immediately of any unauthorised access to your account
- One account per person — creating multiple accounts to manipulate loyalty programs is prohibited
4. Loyalty Points, Stamps, and Rewards
Loyalty points, stamps, and all rewards on the Perks Hive platform have no monetary or cash value. They cannot be exchanged for cash, transferred to another person, or redeemed outside of the specific merchant's loyalty program for which they were earned.
- Points and stamps are earned according to the rules set by each individual merchant
- Rewards are subject to availability and the merchant's terms
- Perks Hive is not responsible for a merchant's failure to honour a reward or voucher — disputes should be raised directly with the merchant first
- Points and stamps may expire as set by the merchant — check the loyalty card for expiry terms
- Perks Hive reserves the right to correct or adjust balances in cases of technical error or fraud
5. Wallet Passes
- Perks Hive issues digital loyalty cards to Apple Wallet and Google Wallet
- Your use of Apple Wallet is subject to Apple's Terms and Conditions
- Your use of Google Wallet is subject to Google's Terms of Service
- Perks Hive is not responsible for issues caused by Apple or Google Wallet platform changes
6. Acceptable Behaviour
You agree not to:
- Attempt to manipulate, hack, or exploit the loyalty system
- Create fraudulent stamp or point transactions
- Use the platform for any illegal purpose
- Harass or abuse merchant staff or other users
7. Account Suspension and Termination
We may suspend or terminate your account if:
- You breach these Terms
- We detect fraudulent activity associated with your account
- We are required to do so by law
You may close your account at any time by contacting us at support@perksapp.co. Upon closure, your loyalty balances will be forfeited and your data will be deleted within 30 days, subject to our legal retention obligations.
8. Limitation of Liability
To the maximum extent permitted by law, Perks Hive's total liability to you for any claim arising from your use of the consumer platform is limited to AUD $50 or the amount you have paid to Perks Hive in the 3 months preceding the claim, whichever is greater.
Perks Hive is not liable for indirect, incidental, consequential, or punitive damages including but not limited to: loss of loyalty points due to merchant closure, platform downtime, or changes to a merchant's loyalty program.
9. Intellectual Property
The Perks Hive platform, including its design, source code, and branding, is the intellectual property of Perks Hive. Merchants retain ownership of their logos and branding assets uploaded to the platform.
10. Dispute Resolution
If you have a dispute with Perks Hive, please contact us first at support@perksapp.co. We will attempt to resolve disputes within 14 business days. If the dispute cannot be resolved, both parties agree to attempt mediation in Melbourne, Victoria before commencing court proceedings.
For disputes regarding specific merchant rewards, please contact the merchant directly in the first instance.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified via the platform with at least 14 days notice before they take effect. Continued use of the platform after changes constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of Victoria, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Victoria.
