3. Merchant & Customer Accounts
Merchants are responsible for the accuracy of their loyalty program rules. Customers are responsible for maintaining the security of their digital wallets. Perks reserves the right to suspend accounts that violate our community standards or engage in fraudulent activity.
4. Intellectual Property
The Perks platform, including its design, source code, and branding, is the intellectual property of Perks. Merchants retain ownership of their logos and specific branding assets uploaded to the platform.
5. Limitation of Liability
To the maximum extent permitted by law, Perks shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the service.
6. Governing Law
These terms are governed by and construed in accordance with the laws of Victoria, Australia. You irrevocably submit to the exclusive jurisdiction of the courts in that State.
